On 9 March 2011, during the hearing in the Supreme Court in the Sohrabuddin and Tulsiram Prajapati fake encounter case, the CBI had said about Amit Shah that he runs a gang of threats and coercion. Then the CBI had said that Shah’s gang is a nexus of leaders, police, and criminals. The CBI had then said before a bench of Justices P. Sathasivam and Justices BS Chauhan that Shah ran a racket of extortion and intimidation in Gujarat through a nexus of politics, police, and criminals. Then Amit Shah’s lawyer Ram Jethmalani had strongly objected to this remark of the CBI. Later, the Supreme Court rejected this observation of the CBI.
The Supreme Court was hearing a petition filed by Tulsiram Prajapati’s mother Narmada Bai. Narmada Bai had demanded a CBI inquiry into the matter. It is said about the Tulsiram Prajapati encounter case that it was sponsored and the encounter was just a drama. Then Narmada Bai had demanded the Supreme Court transfer the case to Mumbai then.
However, in the 2014 judgement, BJP National President Amit Shah got a big relief in the Sohrabuddin and Tulsiram Prajapati fake encounter case. The Special Court of CBI in Mumbai, while giving its verdict on Amit Shah’s application, dismissed all the charges against him. How strict was the CBI’s assessment of Shah then, but now he has been acquitted of these cases. How did such a big change come about?
Jethmalani had expressed anger over the remarks of the CBI on Shah running the gang. Jethmalani had said that Shah was a democratically elected public representative. Opposing this argument, senior Supreme Court lawyer KTS Tulsi on behalf of the CBI had said that many people go if they choose. He had said that being selected is not a certificate of not being a criminal. Jethmalani had said that Shah was being implicated under a political conspiracy. He had said that this conspiracy is being made successful through the CBI.
Regarding the murder of Sohrabuddin Sheikh, the disappearance of his wife Kausherbi, and the murder of Tulsiram Prajapati in the alleged sponsored firing of 2005, the court had said that these are the same type of offence. The court had said that only one type of conspiracy is seen in this. Therefore, these cases will not be investigated separately. The court had said that the Gujarat Police is trying to project these cases separately.
KTS Tulsi told the court that the conflicting charge sheet in a crime is an attempt to save the criminal. Tulsi had said that the accused who will be free in the Tulsiram Prajapati case, how will he be convicted in the Sohrabuddin Sheikh case? KTS Tulsi had said that if the Tulsiram Prajapati case ends with the acquittal of the accused, then there will be no way to prove him guilty in the Sohrabuddin Sheikh case.
On the demand of Narmada Bai, mother of Tulsiram Prajapati, the case was transferred to Mumbai, handed over to the CBI for investigation but justice was not received. Then CBI stated that there is enough evidence against Amit Shah in this case and Amit Shah will definitely get jail. But in 2014 soon after the victory of BJP in India, the CBI court has acquitted him in these cases.
