Country’s First UCC Bill Tabled: To Live-In Or Not To Live-In? Understanding Its Constitutional Challenge

The Uniform Civil Code (UCC) Bill was introduced in the Uttarakhand Assembly on Tuesday, which has raised concerns about privacy and personal liberty. The Bill looks to equate heterosexual live-in relationships to the status of marriage. The proposed Code defines live-in relationships as a “relationship between a man and a woman” who “cohabit in a shared household through a relationship like marriage, provided that such relations are not prohibited.” The Bill requires partners to notify the “Registrar” within a month of entering into a live-in relationship or terminating one. A jail term of up to three months is prescribed for not registering a live-in relationship. A woman whose live-in relationship has ended should be given the same right to terminate an unwanted pregnancy as a widow or divorced woman, the Supreme Court said on Tuesday, indicating that it would interpret the law to include "unmarried women" or "single women" under provisions that allow abortions up to 24 weeks. The court made the observations while hearing a plea by a 25-year-old woman who challenged the 20-week minimum limit under the Medical Termination of Pregnancy (MTP) Act, 1971, which applies to unmarried women seeking termination of pregnancy. Children Of Live-In Couples Also Entitle To Ancestral Property: Supreme Court

A special judgment of the Supreme Court on couples living in a live-in has been instructed. If a couple has children while in a live-in relationship, they cannot be deprived of their ancestral property rights. The country's top court has given such instructions. The Kerala High Court ruled that the law was in favor of marriage and against the concubine. Rejecting the verdict, the high court said that if a man and a woman live together for a long time, their children will get ancestral rights. A bench of Justice S Abdul Nazir and Justice Vikram Nath said, "If a man and a woman live together as husband and wife for many years, they will be considered bound by marriage."
