‘Modern India’ Continues To Cripple With Burden Of Casteism And Blind Orthodoxy

Sayani ChakrabortySeptember 5, 20220

It is widely believed that the caste system is on the decline in today's globalised and contemporary world. At the same time, people of lower castes have been subjected to extreme kinds of discrimination, violence, and humiliation in a variety of settings during the past few years, including public spaces, workplaces, public transportation, and schools. People of lower social classes are being lynched and killed, as well as subjected to physical and verbal abuse, for seemingly trivial reasons, such as using the communal water supply, taking up prime seating in the classroom, owning a horse, or sporting a hip moustache. In recent years, members of the dominant castes have been seen showing solidarity with the accused and viewing the conviction or legal action against them as an affro...

Environmental Challenges Of Belt And Road Initiative Of China, Connecting China To World

Sayani ChakrabortySeptember 3, 20220

The China Belt and Road Initiative (BRI) ties China to the globe by creating a land-based "Silk Road Economic Belt" and a marine "21st Century Maritime Silk Road." By March 2022, 147 countries had invested $28.4 billion in the BRI. Numerous BRI projects would go through ecologically sensitive areas and nations with inadequate environmental laws and governance, raising fears about severe environmental repercussions. The BRI must prioritise green development. In 2007, the 17th National Congress of the Communist Party of China (CPC) introduced "Ecological Civilization" (EC) as a response to environmental deterioration in China. In 2018, it was legally incorporated into the constitution and the country's growth and development strategy. Several policies have been released lately to e...

Kavita Krishnan Steps Down From CPI(ML) Liberation Party Positions Due To “Troubling Questions”

Sayani ChakrabortySeptember 3, 20220

Kavita asked about the similarities between the Soviet Union under Joseph Stalin and the Chinese government now, as well as the similarities between those two governments and the one in India under Narendra Modi. A person in a position of authority, she argued, must refrain from asking such inquiries. After more than two decades of service, Kavita Krishnan, a member of the politburo of the Communist Party of India (Marxist-Leninist) Liberation [CPI (ML) Liberation], resigned from all of her positions within the party over what is being seen as ideological disputes. Despite her assurances to The Hindu that she would remain the party's core member, the CPI(ML) Liberation leadership ultimately opted to expel Krishnan as well. On Thursday, September 1, she published a message on her ...

Concerning Traffic Congestion: Bengaluru Falls Behind Other Indian Cities

Sayani ChakrabortySeptember 1, 20220

India has strict traffic laws. This is the definitive evidence that Hamara's politics will never change. TomTom, a navigation and mapping business, provides us with information for Bharat Mahaan by ranking four Indian cities among the world's 10 worst; as if being home to 9 of the 10 most polluted cities wasn't bad enough. Bangalore, often known as Bengaluru, is the most populous city in the state of Karnataka, ranking first, followed by Mumbai at number four, Pune at number five, and Delhi at number eight. Cities in India, and Asia more generally, have displaced some large U.S. metropolises that were once known for their gridlock among the worst in the world. San Francisco is much ahead of Los Angeles (at 59) and New York (at 52). The Greater Washington area, where I now live, is r...

Sayani ChakrabortySeptember 1, 20220

A Supreme Court bench led by Justice L Nageswara Rao and including Justices B R Gavai and Aniruddha Bose ruled on 3 June 2022 that each national park or wildlife sanctuary must have an ESZ (Eco Sensitive Zone) of at least one kilometre measured from the demarcated boundary of such protected forest, within which the activities prescribed in the guidelines of 9 February 2011 shall be strictly adhered to. The Court determined that no new permanent buildings are allowed in the ESZ. Case: T N Godavarman Thirumulpad v Union of India and Ors. India Experiences Market Uncertainty Amid Bizarre Economic Turn

Sayani ChakrabortySeptember 1, 20220

India is experiencing some strange times. RBI expects inflation to average 6.7% in 2022-23, marking the second time in three years that inflation would exceed 6%. However, overall demand has remained low. The rise of inflation is not the main issue. The repo rate has been lifted by the RBI's monetary policy committee by 1.4 percentage points, to 5.4%, since May in an effort to curb inflation's virtuous cycle. While inflation has moderated in recent months, a reversal of trend is yet possible. On August 26th, a barrel of crude oil in India cost $99.6 per unit. Food grain prices may also be affected by changes in the rainfall pattern. The area planted with paddy and pulses fell by 6% and 5% on August 26. After a poor first half, August saw a dramatic increase in net inflows of about $7 bi...

Criminalization Of Marital Rape In India Remains Unrealized Five Years After ‘Puttaswamy’

Sayani ChakrabortySeptember 1, 20220

The framework of privacy established by the landmark ruling is based on physical integrity, decisional autonomy, individual dignity, and freedom; declaring the marital rape exemption to be "unconstitutional" would be the fitting realisation of this framework. On August 24, 2012, five years ago, the Supreme Court of India issued its historic nine-judge bench judgement in the case of K.S. Puttaswamy against Union of India, finding that the right to privacy is a fundamental right derived from article III of the Indian Constitution. Legal academics at the time stated that Puttaswamy might alter the legal landscape of women's rights in India, but that this would rely on the future case-by-case application of Puttaswamy by the courts. Both the legalisation of same-sex partnerships (in Nav...

Gunjan ChaudharyAugust 31, 20220

There has been an increase of five percent in the cases of cybercrime in the country last year. What is worrying is that charge sheets can be filed in only one third of the cases related to these. This information has been received from NCRB Report 2021. According to the report, a total of 52,974 cybercrime cases were registered in the year 2021, while in 2020 their number was 50,035. In this way, it increased by five percent in 2021, while it saw an increase of more than 15 percent against 44,735 cases in 2019. According to the cybercrime cases registered last year, more than 70 percent cases were registered in Telangana, Uttar Pradesh, Karnataka, Maharashtra, and Assam. Vigillance Commission Guidelines That Apply On Acquisition Of Military Supplies; Read Here!

Sayani ChakrabortyAugust 30, 20220

The people in the MoD and Services are responsible for procuring items and services only if the manuals cover every scenario. General Financial Rules (GFR) regulations are supplemented by the Department for the Promotion of Industry and Internal Trade (DPIIT) and the Central Vigilance Commission's (CVC) tender guidelines. Many acquisition training programmes stress the importance of following both departmental and CVC regulations. It would be a huge task to read the CVC's 72 circulars on public procurement through June 2022 and ensure compliance. This misperception must be addressed. The General Financial Regulations (GFRs) were first released in 1947 and updated by the Department of Expenditure of the Ministry of Finance in 2017. They control ministries' spending on products and se...

U U Lalit Hopes To Make Reforms Despite His Short Stint As Chief Justice Of India

Sayani ChakrabortyAugust 30, 20220

UU Lalit, who is slated to become the next Chief Justice of India, has already made significant progress toward enhancing the internal processes of the Supreme Court. Reviewing the fact that the court has a history of being criticised for taking an excessively slow approach when considering constitutional and other critical matters (such as Article 370, electoral bonds, the EWS quota, etc.), this is of utmost importance. An exciting new method for cataloguing cases, which he has pledged to put into place by Thursday, is currently the subject of much anticipation. The fact that today two constitutional benches, each consisting of five judges, are sitting is another positive development. Yesterday, the bench presided over by CJI Lalit dismissed a number of cases known as public int...

Modi’s Next Weapon To Turn India Into A Dictatorship Is Economic Crimes

Sayani ChakrabortyAugust 29, 20220

Narendra Modi, like Adolf Hitler, wants his party, the Bharatiya Janata Party, to have ultimate power in Indian politics (BJP). To destroy the opposition, his government will use carrot-and-stick techniques. Eight years into Narendra Modi's reign, India's multi-ethnic, multi-religious democracy is under peril. After Modi's BJP won a second term in 2019, the judiciary disintegrated. Justice A. M. Khanwilkar's final two rulings disregarded constitutional rights and the presumption of innocence. Khanwilkar began eroding these safeguards on June 25 when he disdained Zakia Jafri's appeal for justice and pushed the Modi government to prosecute those who assisted her. On July 27, two days before he retired, he dismissed 242 petitions challenging the executive branch's excessive powers to h...

India’s Spoken Language Contrasts Sharply With Administrative And Legal Language

Sayani ChakrabortyAugust 29, 20220

After rejecting the Himachal Pradesh high court's "incomprehensible" verdict, the Supreme Court made a call for "brevity, simplicity, and clarity" across all levels of government. In the HC division bench judgement, one may find gems such as "contra thereto, became adduced by him, and he was thus ordered to dispel the factum" and "the ire res-controversia, exploding interse the plaintiffs, belongs to findings adverse to the workman." If the significance of this nonsense were not so grave, it would be amusing. The governing class of premodern societies confused the administrative language of design. This remained even after the so-called "modernization" began. In various Western democracies, efforts have been made over the last two decades or more to modernise and simplify the vocabu...
