The woman said she was abandoned by her partner.<\/p>\n<p><span class=\"plag_find active\" data-countername=\"plag_match_counter1\">A bench observed, &#8220;Going by the legislative intent, a widow has lost the support of her life partner and in divorce too, there is loss of support from a life partner.<\/span>\u00a0<span class=\"plag_find\" data-countername=\"plag_match_counter2\">This logic will equally apply to a woman who has been abandoned.&#8221;<\/span><\/p>\n<p><img loading=\"lazy\" decoding=\"async\" class=\"size-full wp-image-153098 aligncenter\" src=\"https:\/\/caravanalive.com\/wp-content\/uploads\/2022\/08\/women1.jpg\" alt=\"\" width=\"1031\" height=\"712\" srcset=\"https:\/\/www.caravanalive.com\/wp-content\/uploads\/2022\/08\/women1.jpg 1031w, https:\/\/www.caravanalive.com\/wp-content\/uploads\/2022\/08\/women1-300x207.jpg 300w, https:\/\/www.caravanalive.com\/wp-content\/uploads\/2022\/08\/women1-1024x707.jpg 1024w, https:\/\/www.caravanalive.com\/wp-content\/uploads\/2022\/08\/women1-768x530.jpg 768w, https:\/\/www.caravanalive.com\/wp-content\/uploads\/2022\/08\/women1-450x311.jpg 450w, https:\/\/www.caravanalive.com\/wp-content\/uploads\/2022\/08\/women1-869x600.jpg 869w\" sizes=\"auto, (max-width: 1031px) 100vw, 1031px\" \/><\/p>\n<p>The court reserved its order, indicating that its order would interpret the law to include &#8220;unmarried&#8221; or &#8220;single&#8221; women in the category in question. The specified interval was in Rule 3B(c) of the MTP Rules, 2003 which allows women undergoing a change in marital status during pregnancy through widowhood or divorce. It is to terminate the pregnancy up to 24 weeks.<\/p>\n<p><span class=\"plag_find\" data-countername=\"plag_match_counter3\">The bench added, &#8220;Take a case where a married woman is neither divorced nor widowed but deserted.<\/span>\u00a0<span class=\"plag_find\" data-countername=\"plag_match_counter5\">She is cast away and has no source of livelihood.<\/span>\u00a0<span class=\"plag_find\" data-countername=\"plag_match_counter4\">Should the law be understood to mean that because she is technically not divorced, she cannot have the right to abort her pregnancy?<\/span>\u201d<\/p>\n<p><img loading=\"lazy\" decoding=\"async\" class=\"size-full wp-image-153099 aligncenter\" src=\"https:\/\/caravanalive.com\/wp-content\/uploads\/2022\/08\/women2.jpg\" alt=\"\" width=\"1031\" height=\"712\" srcset=\"https:\/\/www.caravanalive.com\/wp-content\/uploads\/2022\/08\/women2.jpg 1031w, https:\/\/www.caravanalive.com\/wp-content\/uploads\/2022\/08\/women2-300x207.jpg 300w, https:\/\/www.caravanalive.com\/wp-content\/uploads\/2022\/08\/women2-1024x707.jpg 1024w, https:\/\/www.caravanalive.com\/wp-content\/uploads\/2022\/08\/women2-768x530.jpg 768w, https:\/\/www.caravanalive.com\/wp-content\/uploads\/2022\/08\/women2-450x311.jpg 450w, https:\/\/www.caravanalive.com\/wp-content\/uploads\/2022\/08\/women2-869x600.jpg 869w\" sizes=\"auto, (max-width: 1031px) 100vw, 1031px\" \/><\/p>\n<p><span class=\"plag_find\" data-countername=\"plag_match_counter6\">For unmarried women, the judges said, &#8220;For the purpose of a woman\u2019s mental health, both actual and foreseeable factors have to be borne in mind.<\/span>\u00a0<span class=\"plag_find\" data-countername=\"plag_match_counter7\">A woman on is deserted faces foreseeable difficulties.<\/span>\u00a0<span class=\"plag_find\" data-countername=\"plag_match_counter8\">Such a situation where a woman is abandoned will apply to both married and unmarried women.\u201d<\/span><\/p>\n<p><span class=\"plag_find\" data-countername=\"plag_match_counter9\">Additional solicitor general (ASG) Aishwarya Bhati said, &#8220;It becomes more vulnerable for an unmarried woman to survive after desertion as a woman who is married falls back on families but<\/span>\u00a0<span class=\"plag_find\" data-countername=\"plag_match_counter11\">in a live-in relationship, not every time the family is supportive of the woman\u2019s decision.\u201d<\/span><\/p>\n<p><span class=\"plag_find\" data-countername=\"plag_match_counter10\">The bench concluded, &#8220;Why should we not say that such a right be extended up to 24 weeks as all women are equally circumstanced to suffer the same mental agony<\/span>\u00a0<span class=\"plag_find\" data-countername=\"plag_match_counter12\">of an unwanted pregnancy due to failure of the birth control device.&#8221;<\/span><\/p>\n\n<div style=\"font-size: 0px; height: 0px; line-height: 0px; margin: 0; padding: 0; clear: both;\"><\/div>","protected":false},"excerpt":{"rendered":"<p>A woman whose live-in relationship has ended should be given the same right to terminate an unwanted pregnancy as a widow or divorced woman, the Supreme Court said on Tuesday, indicating that it would interpret the law to include &#8220;unmarried women&#8221; or &#8220;single women&#8221; under provisions that allow abortions up to 24 weeks.
