It comes into the category of penetrative sexual assault which is punishable under Section 4 of the POCSO Act.<\/p>\n\n\n\n<p>It is important to note that the Court, in its order, didn&#8217;t take into account Section 5 (m) of the POCSO Act, which stipulates that if the offence of &#8216;penetrative sexual assault&#8217; on a child, who is below the age of twelve years, the same would be punishable with the offence of &#8216;aggravated penetrative sexual assault&#8217; as per Section 6 of the Act.<\/p>\n\n\n\n<figure class=\"wp-block-image size-full\"><img loading=\"lazy\" decoding=\"async\" width=\"1040\" height=\"623\" src=\"https:\/\/www.caravanalive.com\/wp-content\/uploads\/2021\/12\/273509-oral-sex.jpg\" alt=\"\" class=\"wp-image-137358\" srcset=\"https:\/\/www.caravanalive.com\/wp-content\/uploads\/2021\/12\/273509-oral-sex.jpg 1040w, https:\/\/www.caravanalive.com\/wp-content\/uploads\/2021\/12\/273509-oral-sex-300x180.jpg 300w, https:\/\/www.caravanalive.com\/wp-content\/uploads\/2021\/12\/273509-oral-sex-1024x613.jpg 1024w, https:\/\/www.caravanalive.com\/wp-content\/uploads\/2021\/12\/273509-oral-sex-768x460.jpg 768w\" sizes=\"auto, (max-width: 1040px) 100vw, 1040px\" \/><\/figure>\n\n\n\n<p>It may be noted that since &#8216;penetrative sexual assault&#8217; under Section 4 is a lesser offence than &#8216;aggravated penetrative sexual assault&#8217; under Section 6, the Court reduced the sentence of the appellant from 10 years of rigorous imprisonment to 7 years, and further imposed a fine of Rs. 5,000.<\/p>\n\n\n\n<p>The journey from \u201cno\u201d law to deal with sexual abuse of children to have a \u201cspecial\u201d law like The Protection of Children from Sexual Offences Act, 2012 (POCSO) and efforts to implement it, has witnessed contribution from various actors. The POCSO Act is meant to be a socio-beneficial piece of legislation, whose objective is to provide justice to the child. Recognizing the different kinds of sexual offences perpetrated upon a child, the Act has broadened the concept of sexual abuse of children to include sexual acts that involve physical contact, as well as those that do not. It treats as \u201caggravated\u201d the sexual offences committed by specified persons, in a specified manner, or in specified situations.<\/p>\n\n\n\n<p>A child is not a mere \u2018statistic\u2019, and the court a mere \u2019instrument\u2019 for disposal of cases \u2013 other key factors are pivotal to assess a child\u2019s journey towards justice. When demanding separate legislation for sexual offences against children, child rights practitioners consistently reiterated that while working with children, it is the CHILD who should be at the centre-stage, an individual with a distinct personality, history, and circumstances. It is this uniqueness of every child and her\/his case that requires to be considered \u2013 the motives for non-disclosure, or for not registering an FIR, or for not consenting to medical examination, or being tight-lipped in cross-examination, or turning hostile to the prosecution\u2019s case. To ensure justice to a child, it is essential to sensitively delve into her\/his circumstances.<\/p>\n\n\n\n<figure class=\"wp-block-image size-full is-resized\"><img loading=\"lazy\" decoding=\"async\" src=\"https:\/\/www.caravanalive.com\/wp-content\/uploads\/2021\/12\/Silent-no-more-POCSO.jpg\" alt=\"\" class=\"wp-image-137351\" width=\"838\" height=\"491\" srcset=\"https:\/\/www.caravanalive.com\/wp-content\/uploads\/2021\/12\/Silent-no-more-POCSO.jpg 696w, https:\/\/www.caravanalive.com\/wp-content\/uploads\/2021\/12\/Silent-no-more-POCSO-300x176.jpg 300w\" sizes=\"auto, (max-width: 838px) 100vw, 838px\" \/><\/figure>\n\n\n\n<p>India\u2019s National Crime Records Bureau registered 43,000 offenses under the POCSO Act in 2020 \u2014 about one case every 12 minutes. And a study released in 2007 found that boys are equally in danger to be abused as girls.<\/p>\n\n\n\n<p>Police say that in about 90% of the cases, the victims are known to the attackers.<\/p>\n\n\n\n<p>Child sexual abuse is a silent epidemic. It\u2019s everywhere. It\u2019s happening in every second home and across generations. However, there\u2019s stigma and a general reluctance to talk about the topic since many of the abusers are close family members. People, including survivors, say they will sort it out within the family so for every case that reaches court, hundreds don\u2019t.<\/p>\n\n\n\n<p>Last week, Supreme Court struck down a High Court order that cleared a man accused of sexually assaulting a 12-year-old girl because \u201cthere was no skin-to-skin contact\u201d with the victim.
